 TITLE OF BILL :

An act to legalize, validate, ratify and confirm certain
transportation contracts of the Greenport public school district


 PURPOSE :

To validate shared busing transportation contracts between the
Greenport public school district and private contractors from 2001
through 2004, that were disapproved by the New York State Education
Department through clerical error.

 SUMMARY OF PROVISIONS :

Section 1 provides for the approval of contracts relating to shared
busing services between the Greenport public school district and
private contractors for school years 2001 through 2004.  This section
also cures any errors or omissions made by the Greenport public school
district as relates to the submission of these contracts to the New
York State Education Department for approval.

Section 2 states that the New York State Education Department shall
treat the above mentioned transportation contracts as valid and proper

obligations of the Greenport public school district.

Section 3 states that this act shall take effect immediately.

 JUSTIFICATION :

Through administrative error, numerous transportation contracts for
shared busing services between the Greenport public school district
and transportation contractors were not approved by the New York State
Education Department due to the fact that there was missing
documentation required to approve these contracts. The Greenport
public school district was unaware of the fact that this documentation
was missing and as such, they continued to enter into contracts with
these private contractors under the erroneous belief that the
contracts were being approved. This legislation will simply reimburse
the Greenport public school district for expenses that otherwise would
have been approved in the absence of administrative error.

AN ACT to legalize, validate, ratify and confirm certain  transportation
  contracts of the Greenport public school district

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. All acts done and proceedings heretofore had and  taken  or
caused  to  be had and taken by the Greenport public school district and
by all officers, employees or agents of such school district relating to
or  in  connection  with  certain  transportation  contracts:   EO11076,
EO12203,   EO12208,  EO12206,  EO01438,  EO12307  and  EO11079  for  the
2001-2002 school year, EO12203, EO12208 and EO11076  for  the  2002-2003
school  year  and  EO11076, EO01438, EO11079, EO12203, EO12206, EO12208,
E701134 and E701135 for the 2003-2004 school year with various  contrac-
tors,  and  all acts incidental thereto are hereby legalized, validated,
ratified and confirmed,  notwithstanding  any  failure  of  such  school
district  to  comply  with  the  contract  award,  approvals  and filing
provisions of the education law, general municipal law or any other  law
or  any  other statutory authority, rule or regulation, other than those
filing provisions defined in paragraph a of  subdivision  5  of  section
3604  of  the education law, in relation to any omission, error, defect,
irregularity or  illegality  in  such  proceeding  had  and  taken,  and
provided further that any amount due and payable to the Greenport public
school  district  as  a result of this act shall be paid pursuant to the
provisions of paragraph c of subdivision 5 of section 3604 of the educa-
tion law.

  S 2. The education department  is  hereby  directed  to  consider  the
contracts set forth in section one of this act for transportation aid as
valid and proper obligations of the Greenport public school district.
  S 3. This act shall take effect immediately.
