BILL NUMBER: S6318 TITLE OF BILL : An act requiring the state fire prevention and building code council to implement rules and regulations regarding the maple industry PURPOSE OR GENERAL IDEA OF BILL : To require the state fire prevention and building code council to expand the definition of agricultural buildings to include maple production facilities and sugarhouses, and allow such entities to provide for public access and assembly as an agritourism activity SUMMARY OF SPECIFIC PROVISIONS : Section 1 (a) of the bill amends the state building code definition of agricultural buildings to include maple production facilities or sugarhouses to ensure that such facilities are included in code exceptions related to agricultural buildings. Section 1 (b) amends the fire prevention and building code to allow for public access and assembly in sugarhouses as an agritourism activity. JUSTIFICATION : New York State is consistently among the top three maple producing states in the nation, and with more tappable maple trees than any other state or Canadian province there is significant opportunity for growth.

AUBERTINE -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT requiring the state fire prevention and building code council to implement rules and regulations regarding the maple industry THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The state fire prevention and building code council is hereby directed to implement rules and regulations that: (a) include maple production facilities and sugarhouses within the definition of agricultural buildings, so that such facilities will be qualified for exceptions for agricultural buildings; and (b) allow for public access and assembly in sugarhouses as an agri- tourism activity. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD15070-02-9
