BILL NUMBER: S2067 TITLE OF BILL : An act to amend the agriculture and markets law, in relation to certain perishable foods PURPOSE OR GENERAL IDEA OF BILL : To require clear and legible dating along with recommended conditions of storage to ensure freshness of perishable foods which cannot be sold after their freshness date has expired and provides penalties for violations. SUMMARY OF SPECIFIC PROVISIONS : Section 1: Amends Section 16 of the agriculture and markets law by adding a new subdivision 44: A) To receive and evaluate complaints and initiate investigations relating to perishable foods and take appropriate action to stop-sale and stop-removal of such foods where necessary and proper. B) The Commissioner shall have the power to determine reasonableness of any statements or representation as to the state and conditions of storage. Section 2: Amends the agriculture and markets law by adding a new article 12-B Sections 156 j-p as follows:

HUNTLEY, ADAMS, DIAZ, ESPADA, MONSERRATE, PARKER, SAMPSON, SCHNEIDERMAN, STAVISKY -- read twice and ordered printed, and when printed to be committed to the Committee on Consumer Protection AN ACT to amend the agriculture and markets law, in relation to certain perishable foods THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 16 of the agriculture and markets law is amended by adding a new subdivision 44 to read as follows: 44. (A) RECEIVE AND EVALUATE COMPLAINTS AND INITIATE HIS OR HER OWN INVESTIGATIONS RELATING TO MATTERS PROVIDED IN ARTICLE TWELVE-B OF THIS CHAPTER, RELATING TO CERTAIN PERISHABLE FOODS, AND TAKE APPROPRIATE ACTION RELATED THERETO, INCLUDING STOP SALE ORDERS WHERE NECESSARY AND PROPER. (B) THE COMMISSIONER SHALL HAVE THE POWER, AFTER REASONABLE NOTICE AND HEARING, TO DETERMINE THE REASONABLENESS OF ANY STATEMENT OR REPRESEN- TATION AS TO THE DATE AND CONDITIONS OF STORAGE AFFIXED PURSUANT TO ARTICLE TWELVE-B OF THIS CHAPTER. S 2. The agriculture and markets law is amended by adding a new arti- cle 12-B to read as follows: ARTICLE 12-B PERISHABLE FOODS SECTION 156-J. STATEMENT OF LEGISLATIVE FINDINGS AND PURPOSES. 156-K.
