BILL NUMBER: S6299 TITLE OF BILL : An act to amend the alcoholic beverage control law, in relation to the penalty for the illegal sale of an alcoholic beverage to a visibly intoxicated person PURPOSE : To make the selling of alcoholic beverages to any visibly intoxicated person by any person acting under the authority of a license or permit to sell alcoholic beverages for consumption on the premises, a felony. SUMMARY OF PROVISIONS : Section one amends section 65 of the Alcoholic Beverage Control Law by adding a new subdivision 7 that would make the selling of alcoholic beverages to any visibly intoxicated person by any person acting under the authority of a license or permit to sell alcoholic beverages for consumption on the premises, a felony. VOLKER -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the alcoholic beverage control law, in relation to the penalty for the illegal sale of an alcoholic beverage to a visibly intoxicated person THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 65 of the alcoholic beverage control law is amended by adding a new subdivision 7 to read as follows: 7. A VIOLATION OF THE PROVISIONS OF SUBDIVISION TWO OF THIS SECTION BY ANY PERSON ACTING UNDER THE AUTHORITY OF A LICENSE OR PERMIT TO SELL ALCOHOLIC BEVERAGES AT RETAIL FOR CONSUMPTION ON THE PREMISES SHALL BE A FELONY. S 2. This act shall take effect on the first of November next succeed- ing the date on which it shall have become a law.
