AN  ACT  to  amend the general municipal law, in relation to authorizing
  the disposal of computers through donation  to  not-for-profit  insti-
  tutions for use by senior citizens or low income individuals

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1.  Subdivision 2 of section 104-c of  the  general  municipal
law,  as added by chapter 618 of the laws of 1998, is amended to read as
follows:
  2. [Notwithstanding any other provision of  law,  the]  THE  governing
board  of  a  political  subdivision  may  by resolution, adopt policies
authorizing the disposal of computers, computer  software  and  computer
equipment no longer needed for the purposes of the political subdivision
through  donation  to public schools, public libraries, and other public
and private institutions for secular educational use,  and  to  not-for-
profit  institutions  for  use  by individuals with disabilities, SENIOR
CITIZENS, OR LOW INCOME INDIVIDUALS, upon proof of need by such institu-
tion and subordinate to the  requirements  of  the  public  schools  and
libraries of the state. Such donation shall be based on a public notifi-
cation  process  and  competitive proposals from schools, libraries, and
other public and private educational programs for secular education use,
and  not-for-profit  institutions  serving  persons  with  disabilities,
SENIOR CITIZENS, OR LOW INCOME INDIVIDUALS, which shall demonstrate need
and specific plans for the use of such equipment.
  S  2.   This act shall take effect immediately; provided, however that
the amendments to subdivision 2 of section 104-c of the general  munici-
pal  law  made by section one of this act shall not affect the repeal of
such subdivision and shall be deemed repealed therewith.
