BILL NUMBER:S5437 TITLE OF BILL: An act to amend the public authorities law, in relation to increasing the membership of the Orange county water authority PURPOSE: To increase the membership of the Orange county water authority from 5 members to 7 members. SUMMARY OF PROVISIONS: Section 1: Increases the membership of the Authority from five (5) to seven (7) members and amends any references to the number three (3) to read the number four (4) as such references relate to a quorum or action by a favorable vote. Section 2: Enacting Clause JUSTIFICATION: This bill was requested by the Orange County Legislature. The County of Orange believes it to be necessary, and in the best interests of the County and its residents, to increase the capacity, expertise and diver- sity of the Orange County Water Authority. To meet that necessity, the County of Orange desires to increase the membership of the Authority from five (5) to seven (7) members.

LARKIN -- read twice and ordered printed, and when printed to be committed to the Committee on Corporations, Authorities and Commissions AN ACT to amend the public authorities law, in relation to increasing the membership of the Orange county water authority THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 1199-dd of the public authorities law, as added by chapter 709 of the laws of 1987, is amended to read as follows: 1. A public corporation, to be known as the "Orange county water authority" is hereby created for the public purposes and charged with the duties and having the powers provided in this title. The authority shall be a body corporate and politic constituting a public benefit corporation and shall be a "public district" for purposes of section eighty-nine-l of the public service law, the objects of which in the judgment of the legislature cannot be attained under general laws. It shall consist of [five] SEVEN members, who shall be residents of the county and be appointed by the county executive. All members so appointed shall be subject to confirmation by the county legislature. The first members appointed by the county executive shall be appointed for the following terms of office: two for a term ending on December thirty-first of the second year following the year in which this title shall have become law; [and] three for a term ending on December thir- ty-first of the third year following the year in which this title shall have become law; ONE FOR A TERM ENDING ON DECEMBER THIRTY-FIRST, TWO THOUSAND THIRTEEN; AND ONE FOR A TERM ENDING ON DECEMBER THIRTY-FIRST, TWO THOUSAND FOURTEEN. Subsequent appointments of members shall be made for a term of two years ending in each case on December thirty-first of the last year of such term. All members shall continue to hold office until their successors are appointed and qualify.
