BILL NUMBER:S5749 TITLE OF BILL: An act to amend chapter 58 of the laws of 2011, amending the education law and other laws relating to apportionment of school aid, in relation to the effectiveness thereof PURPOSE: To change the effective date. SUMMARY OF PROVISIONS: Section 1: removes language referring to section eighty. Section 2 changes the effective date of sections eighty and eighty-a to July 1, 2012. EXISTING LAW:; Currently, effective date is July 1, 2011 JUSTIFICATION: Would allow BOCES and the Education Department time to prepare a plan to ensure the return of funds is accurate. FLANAGAN -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend chapter 58 of the laws of 2011, amending the education law and other laws relating to apportionment of school aid, in relation to the effectiveness thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph 3 of section 90 of part A of chapter 58 of the laws of 2011, amending the education law and other laws relating to apportionment of school aid, is amended to read as follows: 3. sections twenty-one, twenty-two, twenty-five through twenty-seven, thirty-five through thirty-eight, forty-two, forty-three, forty-six, fifty-one through fifty-four, fifty-eight through sixty, sixty-four, seventy-nine, [eighty,] eighty-two, eighty-seven and eighty-eight of this act shall take effect July 1, 2011; S 2. Section 90 of part A of chapter 58 of the laws of 2011, amending the education law and other laws relating to apportionment of school aid, is amended by adding a new paragraph 3-a to read as follows: 3-A. SECTIONS EIGHTY AND EIGHTY-A OF THIS LAW SHALL TAKE EFFECT JULY 1, 2012. S 3. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD13135-01-1
