BILL NUMBER:S6528 TITLE OF BILL: An act to amend the executive law, in relation to requiring that three percent of all state contracts be procured to veteran-owned and service-disabled veteran-owned businesses PURPOSE OR GENERAL IDEA OF BILL: To require that three percent of all state contracts be procured to veteran-owned and service-disabled veteran-owned businesses SUMMARY OF PROVISIONS: Section 1 of the bill amends section 369 of the Executive Law by adding a new section 1 defining veteran-owned and service-disabled veteran-owned business as fifty-one percent owned by a veteran and having an annual gross sales of less than seventy-five million dollars. Subsection 2 of the bill amends section 369 of the Executive Law by adding a new section 2 requiring the director to promulgate rules and regulations that provide measures and procedures to ensure that three percent of total statewide procurement of state contracts be awarded to eligible veteran-owned and service-disabled veteran-owned businesses.

STEWART-COUSINS, CARLUCCI, OPPENHEIMER -- read twice and ordered printed, and when printed to be committed to the Committee on Veterans, Homeland Security and Military Affairs AN ACT to amend the executive law, in relation to requiring that three percent of all state contracts be procured to veteran-owned and service-disabled veteran-owned businesses THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The executive law is amended by adding a new section 369 to read as follows: S 369. STATE CONTRACT OPPORTUNITIES FOR VETERAN-OWNED AND SERVICE-DIS- ABLED VETERAN-OWNED BUSINESSES. 1. FOR THE PURPOSES OF THIS SECTION, A "VETERAN-OWNED AND SERVICE-DISABLED VETERAN-OWNED BUSINESS" SHALL MEAN A BUSINESS THAT IS: (A) FIFTY-ONE PERCENT OWNED BY A VETERAN AND (B) HAS AN ANNUAL GROSS SALES OF LESS THAN SEVENTY-FIVE MILLION DOLLARS. 2. THE DIRECTOR SHALL PROMULGATE RULES AND REGULATIONS THAT PROVIDE MEASURES AND PROCEDURES TO ENSURE THAT THREE PERCENT OF TOTAL ANNUAL STATEWIDE PROCUREMENT OF STATE CONTRACTS BE AWARDED TO ELIGIBLE VETER- AN-OWNED AND SERVICE-DISABLED VETERAN-OWNED BUSINESSES. 3. THE DIRECTOR SHALL ENSURE THAT EACH CONTRACTING AGENCY ADMINISTERS THE RULES AND REGULATIONS PROMULGATED IN ACCORDANCE WITH SUBDIVISION TWO OF THIS SECTION. S 2.
