BILL NUMBER:S6871 TITLE OF BILL: An act to amend the education law, in relation to authorizing nurse practitioners and physicians to issue non-patient specific orders authorizing registered professional nurses to administer tests to determine the presence of the hepatitis C virus PURPOSE: To allow registered nurses to administer hepatitis C tests under a non-patient specific order issued by a physician or nurse practitioner SUMMARY OF PROVISIONS: Section one amends Education Law § 6909(4) to include administering hepatitis C tests among the non-specific orders that can be issued by a nurse practitioners to a registered nurse. Section two amends Education Law § 6527(6) to include administering hepatitis C tests among the non-specific orders that can be issued by a physician to a registered nurse. Section three provides that the act shall take effect 90 days after enactment. JUSTIFICATION: In 2013, the legislature enacted provisions, bringing New York in line with the Centers for Disease Control and Prevention

HANNON -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend the education law, in relation to authorizing nurse practitioners and physicians to issue non-patient specific orders authorizing registered professional nurses to administer tests to determine the presence of the hepatitis C virus THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 4 of section 6909 of the education law is amended by adding a new paragraph (e) to read as follows: (E) ADMINISTERING TESTS TO DETERMINE THE PRESENCE OF THE HEPATITIS C VIRUS. S 2. Subdivision 6 of section 6527 of the education law is amended by adding a new paragraph (e) to read as follows: (E) ADMINISTERING TESTS TO DETERMINE THE PRESENCE OF THE HEPATITIS C VIRUS. S 3. This act shall take effect on the ninetieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD14396-03-4
