BILL NUMBER:S2359 TITLE OF BILL: An act to amend the real property tax law, in relation to increasing the value of the exemption for certain solar or wind energy systems or farm waste energy systems PURPOSE: To increase the value of the exemption for certain solar or wind energy systems or farm waste energy systems. SUMMARY OF PROVISIONS: This legislation amends Section 487 of the Real Property Tax Law. JUSTIFICATION: As a way to address problems associated with increased energy costs and the general dependency on fossil fuels, several states and local governments have adopted programs to gauge the feasibility of renewable energy sources and to provide financial subsidies to encourage the adoption of those sources deemed to be sustainable energy resources. For example, the Town of Southampton on Long Island, New York, has realized the long-term value that solar and geothermal energy utilization can have on the entire community. As such, the Town has implemented a program which offers a rebate to both residents and local businesses that utilize said alternative

Section 487 of the real property tax law, as amended by chapter 515 of the laws of 2002, subdivision 5 as amended by chapter 366 of the laws of 2010, subdivisions 6 and 8 as further amended by section 1 of part W of chapter 56 of the laws of 2010 and subdivision 9 as added by chapter 608 of the laws of 2002, is amended to read as follows: S 487. Exemption from taxation for certain solar or wind energy systems or farm waste energy systems. 1. As used in this section: (a) "Solar or wind energy equipment" means collectors, controls, ener- gy storage devices, heat pumps and pumps, heat exchangers, windmills, and other materials, hardware or equipment necessary to the process by which solar radiation or wind is (i) collected, (ii) converted into another form of energy such as thermal, electrical, mechanical or chemi- cal, (iii) stored, (iv) protected from unnecessary dissipation and (v) distributed. It does not include pipes, controls, insulation or other equipment which are part of the normal heating, cooling, or insulation system of a building. It does include insulated glazing or insulation to the extent that such materials exceed the energy efficiency standards required by law. (b) "Solar or wind energy system" means an arrangement or combination of solar or wind energy equipment designed to provide heating, cooling, EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. SUMMARY OF PROVISIONS: This legislation amends Section 487 of the Real Property Tax Law. This effective program provides an incentive for those individuals and entities that might not have otherwise chosen to utilize an alternative energy source. Further incentives are necessary to attract more New Yorkers to utilize alternative energy measures. This legislation would increase the value of the real property tax exemption for certain renewable energy or farm waste energy systems.
