BILL NUMBER:S1515 TITLE OF BILL: An act to amend the education law, in relation to the licensing of the profession of acupuncture PURPOSE OR GENERAL IDEA OF BILL: To amend Chapter 504 of the Laws of 2014 allowing a licensed acupuncturist from another state or country to practice acupuncture in this state without a license solely for the purpose of conducting clinical training, practice demonstrations or clinical research that is within the practice of acupuncture in connection with a program of basic clinical education, graduate education, or post-graduate education in an approved school of acupuncture or in its affiliated clinical facility or health care agency, or before a group of licensed acupuncturists who are members of a professional society. SUMMARY OF SPECIFIC PROVISIONS: This bill would make clarifying amendments to Chapter 504 of the Laws of 2014 to make clear that acupuncturists who are licensed in another state or country and who wish to practice acupuncture in New York State in certain limited settings must be in good-standing and are subject to the personal and subject matter jurisdiction and disciplinary and regulatory authority of the Board of Regents. NOZZOLIO -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the education law, in relation to the licensing of the profession of acupuncture THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 8 of section 8216 of the education law, as added by chapter 504 of the laws of 2014, is amended to read as follows: (8) Any person who is licensed AND IN GOOD STANDING to practice acupuncture in another state or country may practice acupuncture in this state without a license solely for the purpose of conducting clinical training, practice demonstrations or clinical research that is within the practice of acupuncture in connection with a program of basic clin- ical education, graduate education, or post-graduate education in an approved school of acupuncture or in its affiliated clinical facility or health care agency, or before a group of licensed acupuncturists who are members of a professional society. ANY PERSON PRACTICING ACUPUNCTURE IN NEW YORK STATE PURSUANT TO THIS SUBDIVISION SHALL BE SUBJECT TO THE PERSONAL AND SUBJECT MATTER JURISDICTION AND DISCIPLINARY AND REGULATORY AUTHORITY OF THE BOARD OF REGENTS AS IF HE OR SHE IS A LICENSEE AND AS IF THE EXEMPTION PURSUANT TO THIS SUBDIVISION IS A LICENSE. SUCH INDI- VIDUAL SHALL COMPLY WITH THE PROVISIONS OF THIS ARTICLE, THE RULES OF THE BOARD OF REGENTS, AND THE REGULATIONS OF THE COMMISSIONER, RELATING TO PROFESSIONAL MISCONDUCT, DISCIPLINARY PROCEEDINGS AND PENALTIES FOR PROFESSIONAL MISCONDUCT. S 2. This act shall take effect immediately and shall be deemed to have been in full force and effect on the same date as chapter 504 of the laws of 2014, took effect.
