BILL NUMBER:S1697 TITLE OF BILL: An act to amend the general business law, in relation to the disposal of counterfeit products PURPOSE OF THE BILL: The purpose of this bill is to include a safety inspection requirement prior to the distribution of donated counterfeit clothing. SUMMARY OF PROVISIONS/ JUSTIFICATION: Chapter 507 of the Laws of 2014 granted courts the option to donate seized counterfeit clothing to recognized charitable organizations with the consent of the trademark owner. This bill includes a requirement that all donated clothing must be inspected prior to distribution to ensure that such clothing is in a condition consistent with federal consumer safety standards that would ordinarily apply to the sale of comparable legitimate products. GRIFFO -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the general business law, in relation to the disposal of counterfeit products THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivisions 5 and 6 of section 360-m of the general busi- ness law, as added by chapter 507 of the laws of 2014 are amended to read as follows: 5. Any NOT-FOR-PROFIT CORPORATION THAT HAS RECEIVED counterfeit or imitation products [received by an organization] through this section must have the products' IDENTIFYING LAWFUL MARK tags removed or have the products marked, altered, imprinted or indelibly stamped so as to prevent their resale or any confusion with the actual products of the lawful mark owner. SUCH PRODUCTS MUST ALSO BE INSPECTED BY THE NOT-FOR-PROFIT CORPORATION TO ENSURE THAT THEY ARE IN A CONDITION CONSISTENT WITH THE FEDERAL CONSUMER SAFETY STANDARDS THAT WOULD ORDI- NARILY APPLY TO THE SALE OF COMPARABLE LEGITIMATE PRODUCTS. 6. Provided, however, that the only counterfeit or imitation products that may be donated pursuant to this section shall be clothing, INCLUD- ING SHOES, and all other counterfeit or imitation products must be destroyed in accordance with this section or any other provision of applicable law.
