BILL NUMBER:S4800 TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to authorizing farm distillery licensees to sell gift items PURPOSE OR GENERAL IDEA OF BILL: To allow farm distilleries to sell gift items. SUMMARY OF SPECIFIC PROVISIONS: Section 1: Amends subdivision 2-c of section 61 of the alcoholic beverage control law by adding a new paragraph (h) Section 2: Effective date JUSTIFICATION: For New York State's four farm-based beverage licenses, three of which have provisions to explicitly allow for non-manufactured items (marketing materials, gifts, apparel, etc.) to be sold on premises However, farm distillers do not have such a provision, thus making sales of other products sold at each distillery a prohibited activity. Farm-based beverage producers, as tourism destinations and regional draws, generate revenue through gifts and destination-specific items. This bill would provide equity for farm distillers with the other farm-based beverage licenses.

FAHY -- read once and referred to the Committee on Economic Development AN ACT to amend the alcoholic beverage control law, in relation to authorizing farm distillery licensees to sell gift items THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2-c of section 61 of the alcoholic beverage control law is amended by adding a new paragraph (h) to read as follows: (H) A FARM DISTILLERY LICENSE SHALL AUTHORIZE THE HOLDER THEREOF TO MANUFACTURE, BOTTLE AND SELL FOOD CONDIMENTS AND PRODUCTS SUCH AS NUTS, POPCORN, MULLING SPICES AND OTHER SPIRITS RELATED FOOD IN ADDITION TO OTHER SUCH FOOD AND CRAFTS ON AND FROM THE LICENSED PREMISES. SUCH LICENSE SHALL AUTHORIZE THE HOLDER THEREOF TO STORE AND SELL GIFT ITEMS IN A TAX-PAID ROOM UPON THE LICENSED PREMISES INCIDENTAL TO THE SALE OF LIQUOR. THESE GIFT ITEMS SHALL BE LIMITED TO THE FOLLOWING CATEGORIES: (I) NON-ALCOHOLIC BEVERAGES FOR CONSUMPTION ON OR OFF PREMISES, INCLUDING BUT NOT LIMITED TO BOTTLED WATER, JUICE AND SODA BEVERAGES; (II) FOOD ITEMS FOR THE PURPOSE OF COMPLEMENTING LIQUOR TASTINGS, WHICH SHALL MEAN A DIVERSIFIED SELECTION OF FOOD THAT IS ORDINARILY CONSUMED WITHOUT THE USE OF TABLEWARE AND CAN BE CONVENIENTLY CONSUMED WHILE STANDING OR WALKING. SUCH FOOD ITEMS SHALL INCLUDE BUT NOT BE LIMITED TO: CHEESES, FRUITS, VEGETABLES, CHOCOLATES, BREADS, MUSTARDS AND CRACKERS; (III) FOOD ITEMS, WHICH SHALL INCLUDE LOCALLY PRODUCED FARM PRODUCTS AND ANY FOOD OR FOOD PRODUCT NOT SPECIFICALLY PREPARED FOR IMMEDIATE CONSUMPTION UPON THE PREMISES.
