BILL NUMBER:S5387 TITLE OF BILL: An act to amend the education law, in relation to notification requirements for school districts located in cities of a million or more when a school district chooses to acquire a site for a new school PURPOSE OR GENERAL IDEA OF BILL: To require that local elected officials and community boards are notified when a site for a new school is chosen in a city of one million or more. SUMMARY OF PROVISIONS: Section one of the bill adds a new section 404-a of the education law, which provides that real property may be acquired in a school district located in a city with a population of a million or more, for school purposes or any other purposes provided in this chapter, after such school district prior to the final purchase of a selected site, provides local elected officials and community board with a detailed analysis of: 1. the reasons why a new school is required, 2. the identification of all sites considered for the new school, and 3. the identification and stated reason for choosing the selected site. The education law is amended by adding a new section 404-a to read as follows: S 404-A. ACQUISITION OF REAL PROPERTY BY SCHOOL DISTRICTS LOCATED IN A CITY WITH A POPULATION OF A MILLION OR MORE. REAL PROPERTY MAY BE ACQUIRED IN A SCHOOL DISTRICT LOCATED IN A CITY WITH A POPULATION OF A MILLION OR MORE, FOR SCHOOL PURPOSES AND FOR ANY OTHER PURPOSE FOR WHICH SUCH PROPERTY MAY BE ACQUIRED AS PROVIDED IN THIS CHAPTER, AFTER SUCH SCHOOL DISTRICT PRIOR TO THE FINAL PURCHASE OF A SELECTED SITE, PROVIDES LOCAL ELECTED OFFICIALS AND COMMUNITY BOARDS WITH A DETAILED ANALYSIS OF: 1. REASONS WHY A NEW SCHOOL IS REQUIRED; 2. IDENTIFICATION OF ALL SITES CONSIDERED FOR THE NEW SCHOOL; AND 3. IDENTIFICATION AND STATED REASON FOR CHOOSING THE SELECTED SITE FOR THE NEW SCHOOL. S 2. BILL NUMBER:S5387A TITLE OF BILL: An act to amend the administrative code of the city of New York, in relation to notification requirements for school districts located in cities of a million or more when a school district chooses to acquire a site for a new school PURPOSE OR GENERAL IDEA OF BILL: To require that local elected officials and community boards are notified when a site for a new school is chosen in a city of one million or more. SUMMARY OF PROVISIONS: Section one of the bill amends the administrative code by adding a new section 25-111-a that allows the city planning commission to regulate the acquisition of real property by the city of New York board of education and the New York city school construction authority which is being purchased for school purposes or for any other purpose for which such property may be acquired. The school district will be required to file a notice of a proposed acquisition of property with the city planning commission and the community board of the locality where the property is location. The notice must contain an description of the proposed acquisition,

B. NO REAL PROPERTY MAY BE ACQUIRED FOR SCHOOL PURPOSES AND FOR ANY OTHER PURPOSE FOR WHICH SUCH PROPERTY MAY BE ACQUIRED, UNTIL THE SCHOOL DISTRICT SHALL HAVE FILED NOTICE OF SUCH PROPOSED ACQUISITION WITH THE CITY PLANNING COMMISSION AND THE COMMUNITY BOARD OF THE LOCALITY IN WHICH THE PROPOSED PROPERTY IS LOCATED. BILL NUMBER:S5387B Revised 06/16/15 TITLE OF BILL: An act to amend the education law, in relation to notification requirements for school districts located in cities of a million or more when a school district chooses to acquire a site for a new school PURPOSE OR GENERAL IDEA OF BILL: To require that local elected officials and community boards are notified and offered an opportunity to provide input at a community forum when a site for a new school is chosen in a city of one million or more. SUMMARY OF PROVISIONS: Section one of the bill amends the education law by adding a new section 2590-v that addresses the regulation of the acquisition of real property by the city of New York board of education and the New York city school construction authority. The school district will be required to hold a public community forum not less than forty-five days nor more than ninety days after a school district's notice of intent to purchase property. The purpose of the forum will be to obtain public and community board input concerning

THE SCHOOL DISTRICT SHALL AFFORD COMMUNITY MEMBERS, REPRESENTATIVES OF THE LOCAL COMMUNITY BOARD, LOCAL BUSINESSES AND RESIDENTS A REASONABLE OPPORTUNITY TO SPEAK ABOUT RELEVANT MATTERS AT SUCH COMMUNITY FORUM, INCLUDING THE APPROPRI- ATENESS OF CONSTRUCTING A NEW SCHOOL AT SUCH LOCATION. EVERY SUCH FORUM SHALL BE HELD UPON NOT LESS THAN TWENTY DAYS NOTICE TO THE AFFECTED COMMUNITY AND THE LOCAL COMMUNITY BOARD. 3.
