BILL NUMBER:S5603 TITLE OF BILL: An act to amend the environmental conservation law, in relation to the powers of the commissioner of the department of environmental conservation PURPOSE: Adding a subsection to the commissioner's duties allowing the commissioner to consider other relevant factors when resolving a dispute between two municipalities. SUMMARY OF PROVISIONS: Section 1: Amends subdivision 4 of section 30301 of the environmental conservation law: to allow the DEC commissioner to examine a municipality's compliance with environmental laws and regulations when resolving a dispute between two municipalities. Section 2 Effective Date JUSTIFICATION: Currently, the commissioner is not able to consider a municipality's environmental track record when trying to resolve a dispute between two municipalities (e.g. a SEQRA lead agency dispute). This legislation will delegate this consideration to the commissioner, creating a more comprehensive review process when resolving disputes, LEGISLATIVE HISTORY: New Bill.

LARKIN -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to the powers of the commissioner of the department of environmental conser- vation THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 4 of section 3-0301 of the environmental conservation law, as added by chapter 719 of the laws of 1981, is amended to read as follows: 4. The commissioner shall: (A) cooperate with the commissioner of the state department of health, district attorneys and the department of law in providing assistance in the investigation and prosecution of violations of article twenty-seven of this chapter; AND (B) CONSIDER COMPLIANCE WITH FEDERAL AND STATE LAWS, REGULATIONS OR PERMITS GOVERNING THE ENVIRONMENT WHEN RESOLVING A DISPUTE BETWEEN TWO OR MORE MUNICIPALITIES.
