BILL NUMBER:S4862 Revised 04/23/15 TITLE OF BILL: An act to amend chapter 522 of the laws of 2000, amending the state finance law and the general business law relating to establishing the underground facilities safety training account, in relation to extending provisions of law relating to the underground facilities safety training account; and to amend the general business law, in relation to protection of underground utility facilities PURPOSE: To extend provisions of law relating to the underground facilities safe- ty training account from October 1, 2015 until October 1, 2020; and to require that any municipality which contracts for excavation of under- ground facilities shall require the excavator to have completed the training and education program provided by the state's one-call notifi- cation system. SUMMARY OF PROVISIONS: Section 1 amends section 4 of Chapter 522 of the laws of 2000, as amended by Chapter 707 of the laws of 2005 and Chapter 372 of the laws of 2010, to extend provisions of law relating to the underground facili- ties safety training account from October 1, 2015 until October 1, 2020.

Section 4 of chapter 522 of the laws of 2000, amending the state finance law and the general business law relating to establishing the underground facilities safety training account, as amended by chap- ter 372 of the laws of 2010, is amended to read as follows: S 4. This act shall take effect thirty days after it shall have become a law and shall expire and be deemed repealed October 1, [2015] 2020. S 2. Section 762 of the general business law, as amended by chapter 685 of the laws of 1994, is amended to read as follows: S 762. Duties of local governing bodies AND MUNICIPALITIES. The local governing bodies shall display in an appropriate location and provide a notice to each applicant for an excavation and demolition permit that informs them about their responsibilities under the law and regulations to protect underground facilities and the existence, operation and programs of the one-call notification system. ANY MUNICIPALITY WHICH CONTRACTS FOR EXCAVATION OF UNDERGROUND FACILITIES SHALL REQUIRE THE EXCAVATOR TO HAVE COMPLETED THE TRAINING AND EDUCATION PROGRAM PROVIDED BY THE ONE-CALL NOTIFICATION SYSTEM PURSUANT TO THIS ARTICLE. BILL NUMBER: S4862C TITLE OF BILL : An act to amend the general business law, in relation to the one-call notification system PURPOSE OR GENERAL IDEA OF BILL : To provide that any local government or operator that contracts for excavation to require the excavator to complete a training and education program. SUMMARY OF SPECIFIC PROVISIONS : Sections one and two of the bill makes a technical and clarifying amendment by replacing the term "governing body" with "local government". Section three provides that any local government that contracts with an excavator to excavate underground facilities must require the excavator to complete the one-call notification system training and education program. Section four provides that any operator that performs excavation work must require the excavator to complete either the one-call notification system or the qualification program pursuant to PSC regulations.
