M. G. MILLER -- read once and referred to the Committee on Economic Development AN ACT to amend the alcoholic beverage control law, in relation to licenses to sell certain alcoholic beverages for consumption on the premises THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 55 of the alcoholic beverage control law is amended by adding a new subdivision 4 to read as follows: 4. NOTWITHSTANDING ANY OTHER PROVISION OF THIS CHAPTER, NO SUCH LICENSE SHALL BE GRANTED FOR ANY PREMISES WHICH SHALL BE ON THE SAME STREET OR AVENUE AND WITHIN TWO HUNDRED FEET OF A BUILDING OCCUPIED EXCLUSIVELY AS A SCHOOL, CHURCH, SYNAGOGUE OR OTHER PLACE OF WORSHIP. § 2. Section 81 of the alcoholic beverage control law is amended by adding a new subdivision 2-a to read as follows: 2-A. NOTWITHSTANDING ANY OTHER PROVISION OF THIS CHAPTER, NO SUCH LICENSE SHALL BE GRANTED FOR ANY PREMISES WHICH SHALL BE ON THE SAME STREET OR AVENUE AND WITHIN TWO HUNDRED FEET OF A BUILDING OCCUPIED EXCLUSIVELY AS A SCHOOL, CHURCH, SYNAGOGUE OR OTHER PLACE OF WORSHIP. § 3. This act shall take effect immediately, and shall apply to licenses granted on or after such effective date.
