 AN  ACT to amend the social services law, in relation to the calculation
   of the shelter allowance for individuals and families receiving public
   assistance and participating in the Section 8 voucher program

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Paragraphs (d) and (e) of subdivision 2 of section 131-a of
 the  social  services  law,  as relettered by chapter 598 of the laws of
 2007, are relettered paragraphs (e) and (f) and a new paragraph  (d)  is
 added to read as follows:
   (D) NOTWITHSTANDING THE PROVISIONS OF THIS CHAPTER OR OF ANY OTHER LAW
 OR REGULATION TO THE CONTRARY, THE AMOUNT TO BE INCLUDED IN THE STANDARD
 OF  NEED  FOR  SHELTER  FOR  AN  ELIGIBLE TENANT WHO PARTICIPATES IN THE
 FEDERAL SECTION 8 HOUSING CHOICE VOUCHER PROGRAM SHALL  BE  THE  MAXIMUM
 SHELTER  ALLOWANCE  PRESCRIBED BY REGULATIONS OF THE DEPARTMENT FOR NON-
 PARTICIPANTS IN SUCH VOUCHER PROGRAM RESIDING  IN  THE  SOCIAL  SERVICES
 DISTRICT IN WHICH THE PARTICIPANT IN SUCH VOUCHER PROGRAM RESIDES.
   §  2.  This  act shall take effect on the ninetieth day after it shall
 have become a law.
