BILL NUMBER:S4932

TITLE OF BILL: An act to amend the labor law, in relation to enacting "Joanne's law"

PURPOSE OR GENERAL IDEA OF BILL: Requires notification of actions of perpetrator of crime in workplace to former employer or workplace.

SUMMARY OF SPECIFIC PROVISIONS: A new section 44 is added to the labor law to require that employers or workplaces are notified if former employees or visitors whom were convicted of violent acts in those workplaces are released from incarceration or violate their probation or parole.

JUSTIFICATION: The purpose of this bill is to notify an employer or workplace when a former employee is released from incarceration or has violated his/her probation or parole, if they committed a crime in that workplace.

This bill would safeguard employers and employees from potential retaliation from former employees who have committed workplace violence or crimes in the workplace. Notifying an employer would enable a workplace to take the proper measures or precautions to protect themselves and their employees.

PRIOR LEGISLATIVE HISTORY: 2010: A.11557 (Rules) Christensen, Referred to Labor.

FISCAL IMPLICATIONS: Minimal to State.

EFFECTIVE DATE: Immediately.
